AISmartz – Terms & Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern your purchase, access, and use of AI Smartz Lite and its associated departmental AI modules (Legal, HR, Marketing & Sales, Procurement & Supply, Finance, and others). By completing your purchase and submitting user details through the post-payment form, you (“the Customer”) agree to these Terms.

2. Subscription & Payment

2.1. Subscription Plans: AI Smartz Lite is available as a monthly or annual subscription per seat. Pricing is displayed on the website at the time of purchase.

2.2. Billing & Payment: All payments must be completed before license activation. Once payment is confirmed, you will be redirected to a user details form to complete license setup.

2.3. Renewals: Subscriptions renew automatically at the end of each billing cycle unless canceled at least seven (7) days before renewal.

2.4. Discounts & Offers: Discounted or bundled offers (e.g., 50% off on additional departments) are valid only when purchased in a single transaction. Smartz AI reserves the right to modify or withdraw offers at any time without prior notice.

3. License & Access

3.1. License Activation: After payment, customers must submit accurate user information via the post-purchase form. Licenses will be provisioned and sent to the provided email addresses within 24–48 hours of submission.

3.2. License Scope: Each seat is allocated to one individual user and cannot be shared, transferred, or reassigned without prior approval.

3.3. Usage Rights: Smartz AI grants a limited, non-exclusive, non-transferable license to use the platform solely for internal business purposes.

3.4. Seat Limitations: AI Smartz Lite allows up to 25 seats per organization per department plan. Additional licenses may be purchased separately.

4. Customer Responsibilities

4.1. Accurate Information: Customers must provide correct details for all users. Smartz AI is not responsible for delays caused by incomplete or inaccurate data.

4.2. Authorized Users: Customers are responsible for ensuring that only authorized personnel access Smartz AI services under their account.

4.3. Compliance: Users must comply with all applicable laws and avoid using Smartz AI for illegal, harmful, or unethical activities.

5. Data Privacy & Security

5.1. Data Handling: User data provided during license setup (e.g., names, email addresses, designations) will be used solely for account creation, license management, and communication purposes.

5.2. Confidentiality: Smartz AI maintains strict data confidentiality and security standards. All customer data is encrypted and handled in accordance with applicable data protection regulations.

5.3. Third-Party Services: In some cases, Smartz AI may utilize third-party infrastructure for hosting or license provisioning. All such partners are bound by equivalent data protection obligations.

6. Cancellations & Refunds

6.1. Cancellations: You may cancel your subscription at any time through the account dashboard or by contacting support. Cancellation will take effect at the end of the current billing cycle.

6.2. Refunds: Payments are non-refundable once the license has been provisioned. Exceptions may apply in cases of duplicate payment or technical failure.

7. Service Delivery & Support

7.1. Delivery Timeline: License credentials are delivered via email within 24–48 business hours after successful payment and form submission.

7.2. Support: Smartz AI Lite customers receive standard support via email. Pro plan users are entitled to dedicated account management and priority assistance.

7.3. Downtime: Occasional maintenance or updates may cause temporary unavailability. Smartz AI will strive to minimize disruption and provide notice when possible.

8. Limitation of Liability

To the fullest extent permitted by law, Smartz AI shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the platform. Total liability, in any case, shall not exceed the total amount paid by the customer during the preceding three (3) months.

9. Intellectual Property

All content, tools, and technologies within Smartz AI remain the sole property of Smartz AI and its licensors. Customers receive no ownership rights beyond their licensed access.

10. Amendments

Smartz AI reserves the right to update or modify these Terms at any time. The latest version will always be available on the website. Continued use of the platform after updates constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Chandigarh, India.
